This Privacy Policy describes how DispatchIt, Inc. ("Dispatch," "we", "us" or "our") handles certain information, including personal information, that we collect about our enterprise customers and drivers (“User,” “Users,” “you,” “your”)through our digital properties that link to this Privacy Policy, including our website and mobile application (collectively “Website”) used to provide an on-demand delivery platform that enables businesses and enterprise customers to track, manage, and share deliveries as they are ordered, and to connect drivers with business and enterprise customers in need of shipments (“Service”), as well as through social media, our marketing activities, our live events and other activities described in this Privacy Policy.  

Dispatch may provide additional or supplemental privacy policies to individuals for specific products or services that we offer or for other purposes at the time we collect personal information. For example, we provide California-based job applicants an Applicant Privacy Notice.

Personal Information We Collect

When you visit our Website, create an account with us as an enterprise customer or driver (“User”), or communicate with us, we may collect certain information about you, which may be personal information. “Personal Information” includes information that is reasonably capable of being associated with, or could reasonably be linked to, a particular consumer or household. This section describes the types of Personal Information we may collect about you, the ways in which we collect such information, and what we do with that information. 

Information you provide to us.  Information you may provide to us through the Website or otherwise includes:

  • Contact data, such as first and last name, email address, mailing address, professional title and company name, and phone number.
  • Sensitive data, such as data that reveals the race, ethnic origin, or religious beliefs, mental or physical health conditions or diagnoses, sexual preferences or orientation, or citizenship status or citizenship of an individual (“Sensitive Personal Information”);
  • Account data, such as the username and password that a User may set to establish an account on the Website for the Service, first and last name, date of birth, vehicle information, car insurance information, business name, business license or permit information, photograph, HAZMAT certification, email address, billing and mailing address, phone number, and any other information that you add to you account profile as a User.  
  • Communications data, based on our exchanges with our Users, including when our Users contact us through the Service, social media, or otherwise and any exchanges between our drivers and our enterprise customers using the Service.
  • Driver earnings data, such as total earnings, earnings history, and earnings per delivery. 
  • Payment information needed to complete transactions, such as payment card information, is collected and processed directly by our payment processor, such as Stripe, as further described below in the “How We Share Your Personal Information” section.
  • Marketing data, such as our Users’ preferences for receiving our marketing communications and details about their engagement with them.
  • Government-issued identification number data, such as national identification number (e.g., Social Security Number and tax identification number), state or local identification number (e.g., driver’s license or state ID number), and an image of the relevant identification card.
  • Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.
  • Transactional data, such as information relating to or needed to complete shipping orders on or through the Service, including order numbers and transaction history. 

Third-party sources. We may combine Personal Information we receive from you with information we obtain from public sources, such as government agencies, public records, social media platforms, and other publicly available sources.

Automatic data collection.  We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and your interaction over time with the Service, our communications and other online services, through the use of Cookies described below, such as:

  • Device data, such as your computer or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., Wi-Fi, LTE, 3G), and general location information such as city, state or geographic area.
  • Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Service, navigation paths between pages or screens, information about your activity on a page or screen, access times and duration of access, and whether you have opened our emails or clicked links within them.
  • Precise and approximate geolocation data when you authorize the Service to access your device’s location for delivery and shipping purposes, or if you have consented to us tracking your location when the Service is inactive. We collect drivers’ precise or approximate location data in connection with the Services, including to enable deliveries, to enable delivery tracking features, to prevent and detect fraud, and to satisfy legal requirements. We collect this data when the Service is running in the foreground (app open and on-screen) or background (app open but not on-screen) of a driver’s mobile device.

Cookies and similar technologies. Some of the automatic collection described above is facilitated by the following technologies:

  • Cookies, which are small text files that websites store on User devices and that allow web servers to record Users’ web browsing activities and remember their submissions, preferences, and login status as they navigate a site. Cookies used on our sites include both “session cookies” that are deleted when a session ends, “persistent cookies” that remain longer, “first party” cookies that we place and “third party” cookies that our third-party business partners and service providers place. 
  • Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data on your device outside of your browser in connection with specific applications. 
  • Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked. Certain sections of our Services and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count Users who have visited those pages or opened an email and for other related website statistics (e.g., recording the popularity of a certain section and verifying system and server integrity, responses to marketing, etc.).
  • Session-replay technologies, such as those provided by LogRocket, that employ software code to record Users’ interactions with the Services in a manner that allows us to watch DVR-like replays of those User sessions. The replays include Users’ clicks, mobile app touches, mouse movements, scrolls and keystrokes/key touches during those sessions.  These replays help us diagnose usability problems and identify areas for improvement.  You can learn more about LogRocket at https://logrocket.com/privacy

Cookies do not contain any information that personally identifies you, but Personal Information that we store about you may be linked, by us, to the information stored in and obtained from cookies. You may remove the cookies by following the instructions of your device preferences; however, if you choose to disable cookies, some features of the Website may not operate properly and your online experience with the Services may be limited. How We Use Your Personal Information 

We may use your Personal Information and Sensitive Personal Information, if any, for the following purposes or as otherwise described at the time of collection:

Service delivery and business operations.  We may use your Personal Information to:

  • provide, operate and improve the Service and our business, such as to send confirmations, delivery updates, and invoices;
  • perform background screening checks on our drivers to ensure that they meet our internal standards; 
  • establish and maintain your User profile on the Service;
  • communicate with you about the Service, including by sending announcements, updates, security alerts, and support and administrative messages;
  • understand your needs and interests, and personalize your experience with the Service and our communications; and
  • provide support for the Website, the Service, and respond to your requests, questions and feedback.

Research and development.  We may use your Personal Information for research and development purposes, including to analyze and improve the Website, Service and our business.  As part of these activities, we may create aggregated, de-identified and/or anonymized data from Personal Information we collect.  We make Personal Information into de-identified or anonymized data by removing information that makes the data Personally Identifiable to you.  We may use this aggregated, de-identified or otherwise anonymized data and share it with third parties for our lawful business purposes, including to analyze and improve the Service and promote our business.

Marketing and advertising.  We, our service providers, and our third-party advertising partners may collect and use your Personal Information for marketing and advertising purposes:

  • Direct marketing. We may send you direct marketing communications.  You may opt-out of our marketing communications as described in the Opt-out of marketing section below.  
  • Interest-based advertising.  Our third-party advertising partners may use cookies and similar technologies to collect information about your interaction (including the data described in the automatic data collection section above) with the Website, our communications and other online services over time, and use that information to serve online ads that they think will interest you.  This is called interest-based advertising. We may also share information about our users with these companies to facilitate interest-based advertising to those or similar users on other online platforms. You may opt-out of our interest-based advertising communications as described in the Opt-out of marketing section below.  

Compliance and protection.  We may use your Personal Information, including Sensitive Personal Information (if any), to:

  • comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities;
  • protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims); 
  • audit our internal processes for compliance with legal and contractual requirements or our internal policies; 
  • enforce the terms and conditions that govern the Service; and 
  • prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.  

With your consent.  In some cases, we may specifically ask for your consent to collect, use or share your Personal Information or Sensitive Personal Information, if any, such as when required by law.  

Cookies and similar technologies. In addition to the other uses included in this section, we may use the Cookies and similar technologies described above for the following purposes:

  • Technical operation. To allow the technical operation of the Service through the Website, such as by remembering your selections and preferences as you navigate the site, and whether you are logged in when you visit password protected areas of the Website.
  • Functionality. To enhance the performance and functionality of our Services.
  • Advertising. To help our third-party advertising partners collect information about how you use the Website and other online services over time, which they use to show you ads on other online services they believe will interest you and measure how the ads perform, unless you opt-out as described in the Opt-out of marketing section below.
  • Analytics. To help us understand user activity on the Service.some text

    • Amplitude. We may use Amplitude to help us measure User engagement, monitor key analytics metrics, and identify conversion and retention factors. You can learn more about how Amplitude processes your information here: https://amplitude.com/privacy

Retention. We generally retain Personal Information to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes. To determine the appropriate retention period for Personal Information, we may consider factors such as the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements.

How We Share Your Personal Information

For the Personal Information we collect about you, we may share your Personal Information and Sensitive Personal Information (if any, and only as necessary) with third parties and as otherwise described in this Privacy Policy or at the time of collection, including with the following entities.  If you permit your Personal Information to be collected and used through the Website for the Services, you are choosing to disclose information to both us and the third parties with which we associate to provide the Service. This Privacy Policy only governs our use of your Personal Information not the use of any information by any other party. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions. We encourage you to read the privacy policies of the other websites, mobile applications and online services you use. See the links below of the third-parties we may work with to provide the Services for more information.

Background screening company, if you sign up to become a driver, we may request that you perform screening checks to ensure that you meet certain standards.  If you consent to a screening check, we may share your Personal Information, including Sensitive Personal Information (if any and only as required), with Yardstick, or another third party, to help us conduct such checks. Service providers.  Third parties that provide services on our behalf or help us operate the Website and provide the Service or our business (such as for billing services, hosting, information technology, customer support, email delivery, marketing, consumer research and website analytics). 

Payment processors. Any payment card information our enterprise customers use to make a purchase on the Website for a Service, or information needed to make payment distributions to our drivers, is collected and processed directly by our payment processors, such as Stripe; we do not store, control, or process any of this information. Advertising partners.  Third-party advertising companies for the interest-based advertising purposes described above. 

Professional advisors.  Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us to enable us operate our business and provide the Services to you.

Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above. 

Business transferees.  Acquirers and other relevant participants in business transactions (or negotiations of or due diligence for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, our or our affiliates (including, in connection with a bankruptcy or similar proceedings).  Such personal information and other data would become the property of the purchaser, subject to the purchaser’s privacy policy.

Your Rights for Personal Information We Collect

For the Personal Information and Sensitive Personal Information we collect about you, you have the following choices with respect to such personal information. 

Enterprise customer rights to information. Enterprise customers  may review, modify, delete, and update certain account information, or request access to and a copy or transfer of the data (including Personal Information) we have collected about them, by logging into the enterprise customer account or by emailing us at drivercare@dispatchit.com. Please note, to help protect your privacy and maintain security, we may take steps to verify your identify prior to granting these rights.

Driver rights to information.  Drivers may send us a request to update, modify, delete, and review their information, or request access to and a copy or transfer of the data (including Personal Information) we have collected about them, by emailing us at drivercare@dispatchit.com. You have the right to affirmatively deny the collection of your Sensitive Personal Information, before that information is collected; if you are not given that option prior to collection, please contact us. Please note, to help protect your privacy and maintain security, we may take steps to verify your identify prior to granting these rights.

Correct Data. You may correct inaccurate Personal Information by contacting us.

Opt-out.  You may opt out of the sale or sharing of your information, including targeted advertising, by contacting us. Additionally, at any time you may opt-out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email you received from us or our marketing vendor, or by contacting us.  Please note that if you choose to opt-out of marketing-related emails, you may continue to receive Service-related and other non-marketing emails.  

Non-discrimination. You have the right not to be discriminated against for exercising any of your rights granted under this privacy policy and applicable privacy laws.

Mobile location data.  You can disable our access to your device’s precise geolocation in your mobile device settings.

Advertising choices.   You may opt-out of use of your information by third-parties as instructed in their privacy policies, and through the following settings/options/tools:

  • Browser settings.  Changing your internet web browser settings to block third-party cookies.
  • Privacy browsers/plug-ins. Using privacy browsers and/or ad-blocking browser plug-ins that let you block tracking technologies. 
  • Platform settings. Google and Facebook offer opt-out features that let you opt-out of use of your information for interest-based advertising.  You may be able to exercise that option at the following websites:some text
  • Ad industry tools.  Opting out of interest-based ads from companies that participate in the following industry opt-out programs: some text
  • Mobile settings.  Using your mobile device settings to limit use of the advertising ID associated with your mobile device for interest-based advertising purposes.

You will need to apply these opt-out settings on each device and browser from which you wish to limit the use of your information for interest-based advertising purposes.  

We cannot offer any assurances as to whether the companies we work with participate in the opt-out programs described above. 

Do Not Track.  Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit.  We currently utilize a tool that integrates the Global Privacy Control (“GPC”) signal to react to the GPC preferences set by you.

Declining to provide information. We need to collect Personal Information to provide certain Services.  If you do not provide the information we identify as required or mandatory, we may not be able to provide those Services, or they may not be provided in the same manner or quality.

Delete your content or close your account. You can choose to delete certain content through your account.  If you wish to request to close your account, please email us at: drivercare@dispatchit.com.  Despite such requests, we may retain certain information, such as driver earnings data, for legal and compliance purposes. 

Use of an Authorized Agent. You may have the right, and California residents do have this right, to use an authorized agent to act on your behalf to submit a request to delete, request to correct, or a request to know about your information. To do this, you must provide your authorized agent signed, written permission act on your behalf. We may deny a request from an authorized agent if the agent does not provide us with your signed permission demonstrating that the agent has been authorized by the you to act on your behalf. 

Other Sites and Services 

The Service may contain links to websites, mobile applications, and other online services operated by third parties. In addition, our content may be integrated into web pages or other online services that are not associated with us. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions. We encourage you to read the privacy policies of the other websites, mobile applications and online services you use.

Security 

We employ a number of technical, organizational, administrative, and physical safeguards designed to protect the Personal Information we collect.  However, security risk is inherent in all internet and information technologies and we cannot guarantee the security of your Personal Information.

International Data Transfer 

We are headquartered in the United States and may use service providers that operate in other countries. Your Personal Information may be transferred to the United States or other locations where privacy laws may not be as protective as those in your state, province, or country.  For more information, please contact us.

Children 

The Service is not intended for use by anyone under 18 years of age. If you are a parent or guardian of a child from whom you believe we have collected information in a manner prohibited by law, please contact us.  If we learn that we have collected information through the Website from a child without the consent of the child’s parent or guardian as required by law, we will comply with applicable legal requirements to delete the information.

Changes to this Privacy Policy 

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Website or other appropriate means.  Any modifications to this Privacy Policy will be effective upon our posting the modified version (or as otherwise indicated at the time of posting). In all cases, your use of the Website and the Service after the effective date of any modified Privacy Policy indicates your acknowledgment that the modified Privacy Policy applies to your interactions with the Website, the Service and our business.
